The new “Taxi Law” of Catalonia seeks to exclude VTCs

Barcelona is preparing for a new Law on the Transportation of People in Vehicles but it is very likely that if we call it that you will have no idea what it is about. If I tell you it’s the new one taxi law, Anti-uber law either Titus Law…things are changing now. And Barcelona tries to shield the taxi. And that, everything indicates, is close to expelling the VTC from the city. A first step. At the moment, what is on the table is the processing of the new Law on the Transportation of People in Vehicles. That is, the law that has to regulate what happens with the operation of VTCs and, above all, if the taxi is declared an asset of commercial interest to protect it against the operation of companies such as Cabify, Uber or Bolt. The debate began last Wednesday after the amendment to the entirety proposed by VOX was rejected, which had the intention of overturning the process to carry out the new regulation that It was presented for the first time last September. Without support and with the abstention of the Popular Party, the procedure will continue its course with the support of PSC, ERC, the CUP, Comuns and Junts. Although, as we will see, we have had a surprise. What is proposed? The intention of the political parties that have supported the processing of the new normal is to protect the taxi from companies such as Cabify or Uber that operate what are known as Transportation Vehicles with Drivers. That is, the VTC. To achieve this, different measures are to be taken: If new licenses have to be created, taxis will be prioritized If a new VTC license is created, it will expire after two years and will be non-transferable Temporary limitations may be imposed on VTCs if it is considered that there is excess supply. Limitation of the service to interurban areas which implies that, in Barcelona, they could not work within the AMB (their metropolitan area) which concentrates the vast majority of trips. In addition, other measures that would affect both VTCs and taxis have also been put on the table: Catalan level B1 for drivers GPS monitoring of vehicles to prevent abuse Introduction of environmental criteria for the creation of new licenses or the withdrawal of existing ones. In favor of the taxi. With these limitations, this new regulation begins to be known as Taxi Law due to the strong defense that is made of this service or as Titus Law because Tito Álvarez, spokesperson for Élite Taxi and who has led a large part of the demands and protests in recent years, is considered to be one of the people who has most influenced the new articles. The last vote on the VOX amendment paves the way for the regulation of the new regulations but, above all, it left the opportunity for political parties to express their opinion. PSC, ERC, the CUP and Comuns have made an expected defense of the sector, after supporting a review of the regulations, although the pro-independence parties defend that drivers have to speak at least B2 of Catalan. In favor of VTC. The support for VTC has come as a surprise. In addition to VOX, which proposed the amendment to the entire new normal, the PP, which abstained, has shown its disagreement by pointing out that “at peak times there are not enough taxis. The VTCs provide a great service”, in the words of Àngels Esteller, a PP deputy, reported by The Country. And, above all, the surprise has come with Junts. And the party supported the new text in September and has opposed the amendment to the entire VOX but has taken advantage of its intervention to position itself in favor of the “6,000 families that live off the VTC” for whom, says Montse Ortiz, Junts deputy, they will fight for modifications worked on through dialogue with the sector. We will guarantee the legal freedom of the sector.” Discrepancies in the taxi sector. As expected, VTC associations and companies have been against the application of the new standard. José Manuel Berzal, executive president of Unauto VTC, assures that the text lacks “legal rigor”, in words reported by The World. And he points out that there are “multiple inconsistencies and contradictions with European law and the jurisprudence of the Court of Justice of the European Union.” The latter is also pointed out from The Vanguardwho claim that a report presented by the Bosch i Gimpera foundation indicates that the text contravenes European law and that the Court of Justice of the European Union will end up overturning it “in a few years.” But what is most striking are the discrepancies within the taxi sector itself. They collect in The World either Taxi Gazette that Tito Álvarez, from Élite Taxi, proposes that VTC licenses can be exchanged for temporary taxi licenses, with a duration of seven years and the possibility of a new extension of one more year. A proposal that has been frontally rejected by other unions such as STC, who describe it as a “genuine insult” that benefits “those who have built their business by breaking the rules while the taxi did comply.” The implications. If the new measure goes ahead with the current proposals, it is expected that they will have an immediate impact on the VTC sector. According to the first calculations: Between 4,000 and 5,000 direct jobs could be eliminated It is estimated that with the new restrictions only 15% of current licenses would be maintained (it is estimated that there are about 4,000 throughout Catalonia) In Barcelona, 600 of the 990 current VTC licenses would be eliminated VTCs would disappear from large cities as they would only be able to make interurban journeys Photo | BYD and Logan Armstrong In Xataka | “I save about 7,000 euros a year on gasoline alone”: three taxi drivers tell us their experience with an electric taxi

Years ago Alicante opted for an artificial island with a luxurious restaurant and taxi boat. It hasn’t turned out as I expected

The idea was good. AND on paper It was fable. Set up a restaurant an artificial island in the heart of the port of Alicante, a benchmark in the Valencian hospitality industry where people could eat paella or have a drink with views of the Mediterranean (directly on it, rather), surrounded by sailboats. So that clients could reach the island, it was even thought to build a taxi boat. The idea sounded so good, in fact, that the Port of Alicante decided to invest heavily in it, dedicating millions of euros to it. Now instead of an idyllic island to drink mojitos and coffees in the middle of the mouth what it has is a huge mess. An artificial island? That’s how it is. To understand it you have to go back a few years, to beginning of 2022when the Alicante Port Authority awarded Vías y Construcciones (subsidiary of the ACS Group) one of its most ambitious projects, at least as far as the interrelation between the docks and the city is concerned. What the Port entrusted to the company was the construction of a large platform at the mouth of its inner dock, a sort of artificial island of 669 m2 (34.8 x 20m) that would be supported with the help of three large 14 m concrete piles anchored to the seabed. The contest was launched with a budget of 2.7 million (taxes apart) and aroused the interest of several companies. The AC Group firm ended up imposing itself on the rest with a project of 2.1 million. And what did they want it for? The platform was just a means, not an end in itself. Its objective was to support a future restaurant located in a privileged enclave, a place that would offer food and drinks not with views of the sea (many bars in Alicante already have that) but directly over the sea. If the island measured 669 m2, the idea was that the building dedicated to hospitality uses would occupy 393 m2 on the ground floor and rise two levels (ground and first floor). The remaining 260 m2 would be dedicated to public access, with a three-meter wide promenade. So that people could reach that privileged enclave, it was also planned a taxi boat. The idea was once again ambitious: a purpose-built, sustainable boat managed directly by the restaurant. Did it stay in theory? No. The Port of Alicante took important steps to make the project a reality. The main one was the awarding of the works for the island platform, which ended up being erected, as can be verified today on the docks. The problem is that what should have been a simple work in theory ended up becoming complicated in a bad way, as recently recognized the Port itself. In 2023 one of the support pillars partially sank, requiring reinforcement work to be carried out on the seabed. From there the project entered a loop that now threatens to condemn it. In fact, the Port insists that it “has never received” the work, which is why it has not considered it good. “Once the work was completed, the contractor company refused to carry out a load test that would allow its stability to be evaluated, as provided for in the contract, and as an essential procedure for the port to sign the acceptance of the work,” remember from the organism. What’s more, he claims to have a report of CEDEX (an entity linked to the Ministry of Transportation) that “strongly advises against” carrying out the tests due to “the high risk of collapse of the structure.” And now what? After years of the open platform crisis and after the latest CEDEX report, the Port has decided to make a radical decision. Its last Board of Directors has given the green light to activate the procedures to “resolve” the construction contract for the island. That is, the organism wants break the agreementsomething that has been communicated to those responsible for Roads and Construction. Now the company has ten days to present allegations. Once that period has passed, “and after years of technical and negative incidents”, the proposal will return to the Board of Directors, something that will probably happen before 2026. “In recent years the Port has commissioned audits and expert reports that confirm the irreversible deterioration of the structure and the impossibility of meeting safety standards to locate the restaurant proposed in the original project,” the organization argueswhich in its 2024 accounts already contemplated “impairment losses” of 2.7 million euros, which it has invested in the platform. Is there anything else? Yes. The Port does not only propose to terminate the contract. He also wants the original seabed to be “restored” to “recover the navigable conditions” that existed before the platform works. If the contract finally ends up being broken, it is not unreasonable to think that the conflict will reach court, but the Port Authority assures that it has already touched all possible sticks, so it sees “all avenues to remedy the situation exhausted.” Are there more affected? The Port of Alicante not only awarded the works on the platform. In April 2022 it launched another contest which completed the project with its second fundamental piece: the building that was to rise above the artificial island to act as a restaurant. The one selected for its construction and management was a business alliance between Alicante Gastronómica SL and Restaura Gestión Forty SL, which from that moment became co-protagonists of the project. In fact, they would not only be in charge of the building, an elliptical, glass-enclosed block with a large interior garden patio, a restaurant with views of Alicante and a terrace for cocktails. Another of its functions would be to assume the “maintenance and governance” of the taxi boat that would connect the island, a ship whose investment, precise Alicante Plazatook over the Port and was commissioned for 460,000 euros (taxes included). In January the organization started to try it. Now … Read more

What you rent is not a taxi, but only a driver for your car

Forget everything you know about taxis and VTC. The new in China is not to rent the services of a vehicle with its driver, but to rent only the services of a driver. The alternative, especially for those who return from a party night, seems perfect. Hello, I need a driver. In this type of service the client performs the request through a mobile app that geolocates, and after confirming the request, the magic arrives. Minutes later comes the driver we had asked and will take us where we want with our own car. These types of applications are known as Dàijià (代驾) (“designated driver”) and are present in the country For years. Skateboards. The curious thing, in addition, is how that driver comes, that when he appears he does it with an electric scooter (or perhaps a compact electric bicycle), something that allows him to move from one point to another in the city where the service operates. Upon reaching your vehicle, that driver or designated driver folds the path and puts it in the trunk. Once it reaches destiny and park your vehicle, take out the stick of the trunk and leave with it. If you drink do not drive. Chinese laws are very hard with drunk drivers, and since 2011 the penalties are severe if the police detect one of these drivers. As in countries like Spain, these drivers are exposed to fines, suspension of driving card and even prison sentences. A social conflict. But it is that in China drinking is a especially important social practice, especially in the business world. Sharing a drink is a way that trust and bonds of union between those who do it. In fact, a traditional toast in China, “Ganbei” (干杯), means “empty cup”, and encourages everyone to finish their drinks even if it is also acceptable to drink only a little. Finishing drinks, yes, is seen as a sign of respect. A perfect solution. That conflict that exists between “having to drink” and driving its car has made this type of services Dàijià They have been located as an ideal solution for each other. A recent statement of the Ministry of Public Security indicated how there had been a significant drop in the number of mortal traffic accidents in the last decade. Li Jiangping, director of the Traffic Management Office, explained that the data is especially positive considering that since 2011 the number of motor vehicles has been increased by 89% and that of drivers by 123%. Millions of journeys. According to the Ministry, the number of accidents in which there were three or more fatal victims had fallen 59.3% since 2012. In that same statement the Ministry indicated that one of the factors of that fall in the accident is that “most people choose to use services of designated drivers after drinking, with the number of requests reaching an annual average of 200 million.” Two giants compete in China for that market. In China there are two great protagonists in this segment. On the one hand it is e-Daijiawhich cleared the land in 2011 upon discovering the service to millions of users. Until 2015 its market share was 90%, but in July of that year Didi launched its own service, Didi Daijiawhich integrated into its own application putting it easier than ever its millions of customers in China. That unleashed a price war that ended up benefiting users and, of course, these services, which have become a unique and interesting alternative to traditional VTCs and taxis.
